What is Fraud?
The four major elements of fraud are:

A false statement of a material matter which is willfully made with an intent to deceive.

Some indicators or “red flags” of workers’ compensation fraud may include:

  • Late reporting of an injury

  • Out of work for more than 30 days for a minor injury

  • Unwitnessed injury

  • Injury occurs in a location where the worker would not normally be

  • Employed for less than 30 days

  • Hard to reach at home while out of work due to injury

  • Cancels or does not show for doctor appointments

  • History of multiple prior claims

  • Lack of cooperation with process

  • Early attorney involvement
